The Basics

What is Personal Information?

Personal Information is any information about personal or factual circumstances that relate to a person. This may include name, date of birth, email address, postal address or telephone number, but also online identifiers such as IP addresses or device IDs.

 

What is processing?

"Processing" is any operation or set of operations that is performed on Personal Information, whether or not it is done automatically. The term is broad and covers virtually any handling of data.

 

Who is responsible for data processing?

The responsible party for data processing is Apollo Academy of Music, LLC (“Apollo Academy of Music“, “we”, “us”, or “our”). If you have any questions or wish to exercise your rights, please contact us.

 

How do we use your Personal Information

In principle, we only process and collect Personal Information if:

●        the data is necessary for the fulfillment of a contract / pre-contractual measures,

●        the data is necessary for the fulfillment of a legal obligation, or

●        the data is necessary to protect the legitimate interests of our company, provided that your interests are not overridden.

 

We process and store your Personal Information only for the period of time required to achieve the respective processing purpose or for as long as a legal retention period (in particular commercial and tax law) exists. Once the purpose has been achieved or the retention period has expired, the corresponding data is routinely deleted.

 

Am I obliged to provide data?

In the context of our business relationship, you are only obliged to provide Personal Information that is required for the establishment, implementation and termination of a business relationship or that we are legally obliged to collect. Without this data, we usually have to refuse to conclude a contract or can no longer fulfill an existing contract and may have to terminate it.

 

Data that we collect automatically

Log data

Each time you visit our website, our system automatically collects the following data from the visiting device and stores it in a so-called log file: (i) name of the file accessed, (ii) date and time of the visit, (iii) amount of data transferred, (iv) notification of successful retrieval, type of browser and version used, (v) IP address (identification of the user's device), (vi) operating system of the visiting device, (vii) Internet service provider of the visiting device, (viii) website from which you access our website, and (ix) which pages of our website you access. The legal basis for this processing is our legitimate interest.

 

Hosting

The hosting services used by us for the purpose of operating our website is Squarespace, Inc. In doing so Squarespace, processes inventory data, contact data, content data, usage data, meta data and communication data of customers, interested parties and visitors of our website and services, on the basis of our legitimate interests in an efficient and secure provision of the website and services in conjunction with the provision of contractual services and the conclusion of the contract for our services, including but not limited to our services).

 

Content Management System

We use the Content Management System (CMS) of Squarespace to publish and maintain the created and edited content and texts on our website. This means that all content and texts submitted to us is transferred to Squarespace. This represents a legitimate interest.

 

Cookies

We use so-called cookies on our website. Cookies are pieces of information that are transmitted from our web server or third-party web servers to your web browser and stored there for later retrieval. Cookies may be small files or other types of information storage. There are different types of cookies: i) Essential Cookies. Essential cookies are cookies to provide a correct and user-friendly website; and ii) Non-essential Cookies. Non-essential Cookies are any cookies that do not fall within the definition of essential cookies, such as cookies used to analyze your behavior on a website (“analytical” cookies) or cookies used to display advertisements to you (“advertising” cookies).

YouTube Videos

We have integrated components from YouTube. The integration requires that YouTube can perceive the IP address of the user. The IP address is required in order to send the video content to the user's browser. If you click on a YouTube component (video) on our website, your internet browser will be prompted by the component to download a corresponding representation of the component. In this way, YouTube knows which specific sub-pages you have visited. The legal basis for the data processing is our legitimate interest and your consent.

 

Third-party services and content

We use content or service offers of third-party providers on the basis of our legitimate interests in order to integrate their content and services.This always requires that the third-party providers of this content are aware of the IP address of the user, as without the IP address they would not be able to send the content to their browser. The IP address is therefore necessary for the display of this content.

Data we collect directly

Contact

The processing of Personal Information depends on the nature of your contact. In addition to your name and email address, IP address or phone number, we usually collect the context of your message, which may also contain certain Personal Information. The Personal Information collected when you contact us is used to process your request, and the legal basis is your consent.

 

We are present on social media (currently Instagram, Facebook, YouTube). If you contact or connect with us via social media platforms, we and the relevant social media platform are jointly responsible for the processing of your data and enter into a so-called joint controller agreement. The legal basis is our legitimate interest, your consent or, in some cases, the initiation of a contract.

 

Bookings

We process your first name, last name, e-mail address, and phone number and, if different, the relevant students first name, last name, age and the data related to your contract with us data to handle the contractual relationship between you and us. The legal basis for the data processing is the fulfillment of our contractual obligations and, in individual cases, the fulfillment of our legal obligations as well as consent.

 

When you use our services

The protection of your Personal Information is particularly important to us in the performance of our services. We therefore only want to process as much Personal Information (for example, your name, address, e-mail address or telephone number) as is absolutely necessary. Nevertheless, we rely on the processing of certain Personal Information, to fulfill our contractual obligations to you or to carry out pre-contractual measures and in the context of administrative tasks as well as organization of our business, and compliance with legal obligations, such as archiving.

 

Online meetings

We also use Zoom (Zoom Video Communications, Inc.) to conduct online meetings, lessons and to provide support. When using Zoom various types of data are processed. The scope of the data depends on the information you provide before or during the online meeting. The processing bases are your consent as well as our legitimate interest.

 

Administration, financial accounting, office organization, contact management.

We process data in the context of administrative tasks and the organization of our business and compliance with legal obligations, such as archiving. In this context, we process the same data that we process in the provision of our contractual services. The processing bases are our legal obligations and our legitimate interest.

 

Payment Data

To make a purchase or pay for services offered, you may need to provide a valid payment method (e.g., credit card). Your payment information will be collected and processed by our authorized payment vendor Stripe. We do not directly collect or store credit or debit card numbers ourselves in the ordinary course of processing transactions. The legal basis for the provision of a payment system is the establishment and implementation of the contract.

 

Service Reviews

We use the rating functions of Google LLC to constantly improve our service, we offer our customers the opportunity to rate us via an independent portal, without us being able to influence this in any way. For this purpose, some data is transmitted to Google. The integration is based on our legitimate interest, and we have no influence or control over the data collected and processed by Google.

 

Klaviyo

We use the services of Klaviyo, Inc to analyze user behavior on our website for our own advertising and market research purposes. Klaviyo also uses cookies and can link your behavior on our website with your data if you have registered for our newsletter or SMS marketing, or gone through an order process on our website. The legal bases are to provide you with our services and your consent.

 

Marketing

If you have given us your separate consent to process your data for marketing and promotional purposes, we are entitled to contact you for these purposes through the communication channels for which you have given your consent.

 

You may give us your consent in a variety of ways, such as by checking a box on a form asking for permission to send you marketing information, or sometimes your consent is implied from your interactions or contractual relationship with us. For business reasons, we analyze the data we have on business transactions, contracts, enquiries,browsing behavior etc., whereby the group of persons concerned may include contractual partners, interested parties, and users of our services.

The analyses serve us alone and are not disclosed externally and processed using anonymous analyses with summarized and or anonymized values. Furthermore, we take the privacy of users into consideration and process the data for analysis purposes as pseudonymously as possible and, if feasible, anonymously (e.g., as summarized data).

Who receives my information?

Within Apollo Academy of Music, those who have access to your information are those who need it to fulfill our contractual and legal obligations.

 

Processors used by us may also receive data for these purposes. These are companies in the areas of IT services, telecommunications, and sales and marketing. If we use processors to provide our services, we take appropriate legal precautions and corresponding technical and organizational measures to ensure the protection of Personal Information in accordance with the relevant legal provisions.

 

Data is only passed on to third parties within the framework of the legal provisions. We only pass on user data to third parties if this is necessary, for example, for contractual purposes or due to legitimate interests in the economic and effective operation of our company, or if you have consented to the transfer of data.

 

How long will my data be stored?

To the extent necessary, we process and store your Personal Information for the duration of our business relationship, which includes, for example, the initiation and execution of a contract.

Is data transferred to a third country?

We may transfer your Personal Information to other companies and/or business partners as necessary for the purposes described in this Privacy Policy. In order to provide adequate protection for your Personal Information when it is transferred, we have contractual arrangements regarding such transfers. We take all reasonable technical and organizational measures to protect the Personal Information we transfer.

 

Automated Decision Making

Automated decision making is the process of making a decision by automated means without human involvement. Automated decision making does not occur.

 

COPPA (Children Online Privacy Protection Act)

When it comes to the collection of Personal Information from children under the age of 13 years old, the Children’s Online Privacy Protection Act (COPPA) puts parents in control. The Federal Trade Commission, United States’ consumer protection agency, enforces the COPPA Rule, which spells out what operators of websites and online services must do to protect children’s privacy and safety online. Specifically, COPPA stipulates that a) we must seek and require verifiable parental consent; b) we must provide an appropriate privacy policy, and c) clearly set out our responsibilities regarding children's privacy and safety online.

 

CAN SPAM Act

The CAN-SPAM Act is a law that sets the rules for commercial email, establishes requirements for commercial messages, gives recipients the right to have emails stopped from being sent to them, and spells out tough penalties for violations. To be in accordance with CAN SPAM, we agree to the following: If at any time you would like to unsubscribe from receiving future emails, you can email us, and we will promptly remove you from ALL correspondence.

 

Controls For Do-Not-Track Features

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ('DNT') feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, our website does not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this policy.
